A personal injury liability action, tried in Supreme Court, Sullivan County before Judge Schick and a jury, involving a head-on collision between two cars resulted in a successful defense verdict. Plaintiff and Defendant were driving in opposite directions when Plaintiff took a left into Defendant’s lane-of-travel. Dan Chao, an associate at The Law Offices of Craig P. Curcio, contended at trial that Defendant was not negligent because he did not speed or have a chance the avoid the accident. The case was bifurcated, with liability being tried first. It took the jury approximately 4 minutes to return a unanimous verdict absolving Defendant of any responsibility.
