On a motion to enforce a settlement, Daniel Chao was successful in getting the court to agree that the terms of a settlement negotiated between the parties was binding on them. This slip and fall accident, venued in Supreme Court, Westchester County, alleged negligence against the contractor who maintained the property resulting in personal injury to the plaintiff. Plaintiff’s attorney negotiated a settlement of the case via email but subsequently attempted to renege on the deal when his client refused to be held to its terms. The Law Offices of Craig P. Curcio asserted that all parties had reached an accord and the settlement must be enforced. The Court agreed that the plaintiff had consented to the settlement and ordered her to accept it.
