Doug goldberg wins summary judgment in motor vehicle accident case

Multiple plaintiffs were passengers in a Westchester County Bee-Line bus that was making a left turn.  The bus driver told police she had a green turn arrow, and wrote the same thing in her own incident report.  She also testified that the adverse vehicle had its right turn signal on, implying that it was safe for her to make the left turn.  There was a video camera in the bus facing out the windshield, which captured the happening of the accident, including the traffic light for the bus driver as well as the approach of the adverse vehicle (Doug’s client) which was headed opposite the bus and which was intending to proceed straight through the intersection. The video showed that the bus driver had a green light but not a green arrow; it also showed no operating turn signal on the adverse vehicle.  This meant that Doug’s client also had a green light – as well as the right of way over the bus.  The video was attached as an exhibit to Doug’s motion, which persuaded the Court to dismiss the case against his client.
